Rehabilitation in the Italian Criminal Code

Criminal rehabilitation is provided by the articles 178 and following articles of the Italian Criminal Code. It refers also to alternative sanctions and any other punishment effect except when the law provides otherwise.

What conditions are required by the Italian Criminal Law for the concession of the rehabilitation to those who have committed a criminal offence provided and punished by the Italian Criminal Code?

After 3 years from the day when the punishment has been completed or when in some other way it has extinguished and the convict has provided evidence of constant good conduct.

After 8 years for those who are repeat offenders in those cases provided by the article 99 of the Italian Criminal Code

After 10 years for habitual offenders or professionals

After 1 year in case of granting of suspended sentence as provided by the article 163.4 of the Italian Criminal Code (so not in all cases of suspended sentences and only if also are fulffilled the other conditions provided by article 179 of the Italian Criminal law)

In what cases rehabilitation cannot be granted according to the Italian Criminal code?

When a person has been condemned and has been submitted to security measures except when it refers to expulsion of aliens or to confiscation and the provision has not been revoked.

When the condemed has not fulfilled the civil obligations due to the offence he has committed unless he/she has evidence of not being able of fullfilling them.
