Offence of child abduction by a parent in Italy according to the Italian Criminal Code

It is regulated by the article 574bis of the Italian Criminal Code the child abduction in a foreign Country.

The above article establishes that execpt from those cases when the offence consists in a more serious crime the parent who has abducted a child to the other parent or tutor holder of parental responsibility moving abroad against the other parent's or tutor's will must be sentenced to 1-4 years in prison.

If the above situation happens to an at least 14-years-old child then the sentence is between 6 months and 3 years in prison.

Article 574 bis of the Italian criminal Code establishes that if this crime has been committed by a parent holder of parental responsibility this will cause the suspension of parental responsibility.
