Italian Law- Criminal Impersonation in Italy

The Italian Supreme Court of Cassation (Criminal section) has established in Rome with ruling number  2905 and also with ruling 2942 that access to the facebook profile of one's partner without been authorized is a crime in Italy.

The first section of the Italian Supreme Court consideres that even if the partner knows the password of an account of the other partner this cannot  justify accessing to private conversations and nor the exclusion of the partner from his/her own Facebook account or preventing him/her from accessing to his/her accounts.

The same must be said with reference with ruling  2942 where a man had appealed against a ruling in Italy having been also charged with the crime of impersonation (we refear exactly to that criminal offence called in Italy, in Italian “reato di sostituzione di persona”) because he login to the partner's Facebook account without authorization but also to her email account and had also changed the password and he had also committed the crime of impersonation in Italy writing on her behalf  injurious sentences to the one who was at that time the boyfriend of her ex- partner.
