What is the competent Authority in case of International child abduction?
International child abduction within the European Union (EU)
Regulation 2201/2001 is used to establish what jurisdiction is competent in cases of child abduction if it is necessary to establish what Court is competent to rule on the child's return for instance between a Spanish “Juzgado” and an Italian “Tribunale” if a child has been abducted in Italy or in Spain en la Unión Europea en estos supuestos al Reglamento 2201/2003.
Regulation 2201/2003 concerning jurisdiction and the recognition and enforcement of judgments in matrimonial matters and the matters of parental responsibility applies in Italy and in Spain and in all of the European Union State Members.
Article 10 of regulation 2201/2003 establishes competence in cases of child abduction.
At first it establishes that the competent Authorities are those where the child usually.
For instance if a chuild lives in florence, in Italy, he/she studies and resides usually in bthe Italian “regione Toscana” the Italian Courts will be firstly competent.
But it also establishes a different juridisdiction if the child for a long period has acquired an usual residence in another State Member etc.
