Alimony payment in Italy: Ruling of January,20th 2020 of the Italian Court of Cassation

The Civil section of the Italian Court of Cassation (Corte di Cassazione italiana) with the ruling of January,20^th 2020, has established that the jurisprudential shift regarding payment of alimony in Italy does not mean by itself the existence of “giustificati motivi sopravvenuti” that is of proper circumstances to decide on alimony review required by the first paragraph of article 9 of Law 898/1970 (Italian divorce Law). In fact to determine the existence of proper circumstances that is in italian of “giustificati motivi” it is necessary to verify factual elements related to the variation of the patrimonial condition of the parts.  

The recent rulings and the jurisprudential evolution related to payment of alimony in Italy has been established especially with ruling of May,10^th 2019 of the Italian Court of Cassation (Section n.1) and with the ruling of July,11^th 2018 of the United Divisions of the Italian Supreme Court of Cassation .
