Judgment of the Italian Constitutional Court No. 25/2025, published on March 12, 2025.
In judgment n. 25/2025 of the Italian Constitutional Court it was declared “the constitutional illegitimacy of art. 9.1 of the law 5 february 1992, n. 91 (new rules on citizenship), introduced by art. 14, paragraph 1, letter a-bis), of the decree-law 4 october 2018, n. 113 (urgent provisions concerning international protection and immigration, public safety, as well as measures for the functionality of the ministry of the interior and the organization and functioning of the national agency for the administration and destination of assets seized and confiscated from organized crime), converted, with modifications, into law 1st december 2018, n. 132, in the part in which it does not exempt from the proof of knowledge of the italian language the applicant affected by severe limitations to language learning capacity deriving from age, from pathologies or from disabilities, certified by means of certification issued by the public healthcare facility”.
